Smith & Noble (“Smith & Noble”, "we" or "us") provides this and other websites (including applications and other online services that are accessible through various desktop, tablet and mobile web browsers from time to time) (collectively, "Sites") subject to your compliance with these Terms and Conditions.
PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE SITES. These Terms and Conditions constitute an agreement between us and you. By using the Sites, you affirm that you are able and legally competent to agree to and comply with these Terms. If you do not agree to these Terms or if you are not legally competent to agree to them, then you may not use the Sites.
Please note that these Terms contain provisions that govern the resolution of claims between us and you.
RETURNS & CANCELLATIONS
To ensure the fastest delivery possible, your products are put into production right away and are shipped as soon as they have been manufactured. We cannot change or cancel an order once it goes into production. If additional information is required to process your order, one of our designers will contact you shortly.
Because our products are custom-made to your exact specifications, we do not offer refunds once production has begun.
All of the products we sell are covered by a limited lifetime warranty. This warranty covers any defects in materials, workmanship, mechanism and operation, as long as the product is measured and installed according to the recommended product instructions and specifications. Any defects will be repaired at the sole expense of Smith & Noble during the warranty period, with the exception of the limitations described here.
Under normal use, your window treatments should work well for many years. Within the first 60 days after purchase, we’ll repair or replace it as it was originally ordered. Sixty days after order receipt, our limited lifetime warranty applies. If you used our in-home design or measure & installation service, we’ll send our pro back out at no charge within the first year after purchase. After the first year, there is a charge for our installation professionals.
Our custom window treatments are expressly and uniquely manufactured to your exact specifications and preferences. As such, they cannot be returned nor refunded.
No part of the Sites is directed to persons under the age of 13. IF YOU ARE UNDER 13 YEARS OF AGE, DO NOT USE OR ACCESS THIS SITE.
TERMS OF SALE
The terms of sale with regard to the placement of orders and the purchase of products from Smith & Noble through our website are governed by these Terms and other purchase-related policies available on our website, such as the "Return & Cancellation" policy which is in effect at the time of purchase.
Unless otherwise noted, all content included on the Sites, including images, illustrations, designs, icons, photographs, video clips and written and other materials (together, "Smith & Noble Content") is the property of Smith & Noble or its licensors, partners or affiliates and is protected by United States and international copyright laws. Any unauthorized use of any Smith & Noble Content on the Sites is strictly prohibited and may violate copyright and trademark laws, and/or the laws of privacy, publicity, and/or communications regulations and statutes. You may use the materials or content on the Sites only with our prior written and express authorization.
All trademarks, service marks, and trade names (collectively the "Marks") that appear on the Sites are proprietary to Smith & Noble, or the other respective owners of such Marks. You may not display or reproduce the Marks in any manner without the prior written consent of Smith & Noble, and you may not remove or otherwise modify in any manner any trademark notices from any content offered or received through the Sites.
The receipt of an order number or an email order confirmation does not constitute the acceptance of an order or a confirmation of an offer to sell. While we try to ensure accuracy, Smith & Noble reserves the right, without prior notification, to correct any pricing, typographical, or other errors, and to cancel or refuse to accept any order based on an incorrect price or description. Such c orrections or cancellations may be made even after an order is accepted.
LIMITATION OF LIABILITY
YOU EXPRESSLY UNDERSTAND AND AGREE THAT, TO THE FULLEST EXTENT PERMITTED BY LAW, SMITH & NOBLE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND PARTNERS ("THE RELEASED PARTIES") WILL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF SMITH & NOBLE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SITES; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH, FROM, OR AS A RESULT OF THE SITES; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY USER OR THIRD-PARTY ON THE SITES; (v) YOUR RELIANCE ON CONTENT MADE AVAILABLE BY US; OR (vi) ANY OTHER MATTER RELATING TO THE SITE. TO THE FULLEST EXTENT PERMITTED BY LAW, THE RELEASED PARTIES' MAXIMUM LIABILITY ARISING OUT OF OR IN CONNECTION WITH THE SITES, REGARDLESS OF THE CAUSE OF ACTION (WHETHER IN CONTRACT, TORT, BREACH OF WARRANTY, OR OTHERWISE), WILL NOT EXCEED $100.
COLOR & MATERIAL REPRESENTATION
The only way to be sure you’re ordering the exact color you want is to order samples first. Colors and textures on your computer monitor may vary slightly from the actual materials. Please note that window treatment samples are not backlit when photographed, and may appear different in your windows. If an exact color match, privacy level or texture is needed, please order sample materials before placing your order.
PRODUCT PRICING POLICY
On rare occasions, the price quoted to you on our website may be incomplete or inaccurate. In the case of an overcharge, you will automatically receive a refund of the overpayment or credit to your billing account within 3-5 business days. If you were undercharged, we will contact you and request the additional amount before completing your order; you will also have the option to cancel the order at this time. Should you choose not to remit the outstanding sum, Smith & Noble reserves the right to cancel your order.
